Terms of Service
Effective May 13, 2026
These Terms of Service (“Terms”) govern your access to and use of the MyTrainingPros platform and related websites, applications, and services (collectively, the “Service”). By creating an account or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility & accounts
- You must be at least 18 years old (or the age of legal majority in your jurisdiction) and able to enter into a binding contract.
- If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization, and “you” refers to both you individually and the organization.
- You are responsible for the accuracy of the information you provide, for safeguarding your password, and for all activity that occurs under your account.
- You agree to enable two-factor authentication where offered for any administrative role.
- You will notify us promptly at admin@mytrainingpros.com of any unauthorized use of your account.
2. The Service
The Service helps training companies schedule and run classes, manage students and instructors, issue certificates of completion, post jobs and review applicants, and operate related workflows. Features available to your account depend on your role (super admin, company admin, instructor, or student) and your company's subscription plan.
3. Subscriptions, fees, and refunds
- Platform subscription — companies pay MyTrainingPros a recurring subscription fee (monthly or yearly) to access paid features. Pricing is shown in-app at the time of purchase.
- Class fees (BYO Stripe) — companies may collect class fees from students using their own connected Stripe account. Funds flow directly to that company; MyTrainingPros does not hold those funds. The company is responsible for refunds and tax compliance on those payments.
- Billing — fees recur automatically until you cancel. You authorize us (and our payment processor, Stripe) to charge your payment method for amounts due.
- Past-due accounts — if a payment fails and remains unpaid, we may suspend access until the balance is resolved.
- Refunds — except where required by law, subscription fees are non-refundable. You can cancel renewal at any time from Billing → Manage subscription; cancellation takes effect at the end of the current billing period.
- Taxes — fees do not include taxes; you are responsible for any taxes that apply to your purchase.
4. Acceptable use
You agree not to, and not to permit anyone else to:
- Use the Service in violation of any law or third-party right.
- Upload or transmit content that is unlawful, harassing, defamatory, deceptive, infringing, hateful, sexually exploitative, or that contains malware.
- Issue, alter, or distribute training certificates that are false, misleading, or that misrepresent a person's qualifications.
- Post job listings that are fraudulent, discriminatory in violation of applicable law, or that solicit applicants for unlawful work.
- Probe, scan, or test the vulnerability of the Service; attempt to bypass authentication or rate limits; or interfere with other users' access.
- Reverse engineer, decompile, or attempt to extract source code, except to the extent applicable law expressly permits.
- Use the Service to send unsolicited bulk messages or to harvest user data.
- Resell, sublicense, or white-label the Service without our prior written consent.
5. Your content
You retain ownership of content you upload or create on the Service (including class materials, certificates, posts, comments, messages, resumes, forms, and logos — “Your Content”). You grant MyTrainingPros a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, display, and process Your Content solely as needed to operate, secure, and improve the Service and to provide it to you and the people you authorize.
You represent that you have the rights necessary to grant this license, that Your Content does not violate these Terms, and that the people whose information you upload (e.g., students, instructors, applicants) have been informed and where required have consented to that processing.
6. Customer-to-customer interactions
The Service lets companies post jobs, accept applications, message students, and run social features (feed, follows, groups). MyTrainingPros is not a party to your dealings with other users (companies, instructors, students, or applicants) and is not responsible for those interactions, hiring decisions, training outcomes, refunds between you and another user, or any disputes that arise between you.
7. Stripe and payments
Payments are processed by Stripe under Stripe's terms and privacy policy. You authorize us to share with Stripe such information as is necessary to process your transactions. We are not responsible for errors, delays, fees, or other issues caused by Stripe or your bank.
8. Email, reminders, and cron jobs
The Service sends transactional and operational emails (e.g., login alerts, class reminders, past-due notices, certificate emails, job-application notifications). You agree to receive these as part of using the Service. Where you opt in, we may also send platform-wide notifications such as new job alerts; you can change those preferences in Account → Settings.
9. Intellectual property
The Service, including its software, design, logos, and branding, is owned by MyTrainingPros and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service in accordance with these Terms. We reserve all rights not expressly granted.
If you submit feedback or suggestions, you grant us a perpetual, royalty-free license to use them without restriction.
10. Third-party services
The Service may integrate with third-party services (such as Stripe, calendar providers, and SMTP providers). Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services.
11. Confidentiality
You will not disclose non-public information about the Service (including beta features, prices not publicly listed, or vulnerabilities) to anyone without our prior written consent. If you believe you have found a security vulnerability, please report it to admin@mytrainingpros.com instead of disclosing it publicly.
12. Termination
- By you — you can cancel renewal or close your account at any time. Some content may remain in backups for a limited period as described in our Privacy Policy.
- By us — we may suspend or terminate your access if you violate these Terms, if your account becomes seriously past due, if required by law, or to protect the Service or other users.
- Effect of termination — sections that by their nature should survive (including ownership, indemnification, disclaimers, limitation of liability, and dispute resolution) will survive termination.
13. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. CERTIFICATES AND TRAINING RECORDS GENERATED BY THE SERVICE REFLECT THE INPUTS YOU AND YOUR INSTRUCTORS PROVIDE; YOU ARE RESPONSIBLE FOR THEIR ACCURACY AND FOR ANY REGULATORY COMPLIANCE THEY REQUIRE.
14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MYTRAININGPROS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR (A) ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR (B) ANY LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA, IN EACH CASE WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (i) THE FEES YOU PAID TO US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (ii) ONE HUNDRED U.S. DOLLARS ($100).
15. Indemnification
You agree to defend, indemnify, and hold harmless MyTrainingPros and its affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your use of the Service, (b) Your Content, (c) your violation of these Terms, or (d) your violation of any law or third-party right.
16. Governing law & disputes
These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in the State of New York, and you consent to personal jurisdiction there. The U.N. Convention on Contracts for the International Sale of Goods does not apply.
17. Changes to the Service or Terms
We may modify the Service at any time. We may also update these Terms; if changes are material, we will notify you (by email or in-app) before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
18. Miscellaneous
- Entire agreement — these Terms and our Privacy Policy are the entire agreement between you and us regarding the Service.
- Severability — if any provision is unenforceable, the rest remains in effect.
- No waiver — our failure to enforce a provision is not a waiver of our right to do so later.
- Assignment — you may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- Notices — we may give notice by email or by posting in the Service. You can reach us at admin@mytrainingpros.com.
